More details have emerged about the domestic violence complaint against 49ers linebacker Reuben Foster, including a previously unreported allegation that he threw his ex-girlfriend's dog across a room. The woman flagged down a stranger's vehicle on Shannon Road and asked the driver to call 911, according to the Santa Clara County district attorney's office. In April, Foster's girlfriend, Elissa Ennis, issued a statement through her attorney, Stephanie Rickard, recanting the allegations and saying she made up the story about Foster punching her repeatedly in an attempt to "trash his career" after Foster tried to break off the relationship.Rickard provided the district attorney video evidence just two weeks ago that the defense says will exonerate Foster.
Ennis told police that the argument began the night of February 10 and Foster threw her dog, which was not injured, across the room.
Foster, 24, was charged with felony domestic violence after being accused of punching his 28-year-old girlfriend in the head 10 times and rupturing her ear drum in a brutal attack at their home in northern California in February, and was arrested the same month.
Ennis now says she sustained those injuries in a road-rage incident that resulted in a fight with another woman and provided video of the purported incident. He faces two charges of domestic violence and one felony charge of possession of an assault weapon. The latter was found on the floor of the bathroom with a loaded 30-round magazine and a round in the chamber. "In a statement through attorney Stephanie Rickard, Ennis said those allegations were "based on lies" and that "(Foster) did not strike her, injure her or threaten her".
But the District Attorney's Office, which is reviewing video of the fight between the two women, said that they were continuing to pursue the charges. It's unlikely prosecutors would exercise their option to file false-reporting charges against Ennis because their own case rests on bolstering the authenticity of the initial account she gave to police, as well as relying on other independent evidence like medical records, witness accounts and the 911 call.
The Sacramento Bee reported police found two loaded guns at the home - a.38-caliber pistol and a Sig Sauer short-barreled rifle.
Clark said that the May 17 date - just nine days from Tuesday's hearing - was significant.
The ex-girlfriend of Reuben Foster initially told responding police that the San Francisco 49ers linebacker had physically thrown her out of his residence and struck her several times. Foster then grabbed the phone and smashed it, she said in the report.
Due to the addition of the video evidence, Foster's plea hearing was delayed until May 8. She later ran out to a passing motorist who she asked to call 911 on her behalf. General manager John Lynch released a statement in April saying Foster "won't be a part of this organization going forward" if the allegations against him are proven to be true.
