Court orders parole board to consider offender's age at the time of the crime

Vermont law already prohibits juvenile life without parole

A U.S. Supreme Court ruling stating juveniles can not automatically be sentenced to life in prison without parole has not been an issue in Alaska.

Eight men are serving life sentences without parole for homicides they committed or were involved in when they were under 18, according to state prison records.

After the Supreme Court's 2012 ruling, Missouri lacked valid sentencing guidelines for juvenile murderers, forcing the state's prosecutors to instead charge young offenders with second-degree murder.

Devonere Simmonds of Columbus is serving a life sentence without parole for a July 2013 crime spree that left two people dead, when Simmonds was 17.

Juveniles can still be sentenced to long prison terms as a result of serious crimes or multiple charges.

The U.S. Supreme Court has been clear and consistent: In successive decisions over more than a decade, the justices said the harshest punishments levied against adult criminal offenders are unconstitutionally cruel and unusual when imposed on juveniles.

The California District Attorneys Association opposes the bill, saying it's unfair to retroactively allow the same 25-year minimum penalty for no-parole felons as for those sentenced to lesser terms of 25-to-life.

However, corrections officials say there are no known inmates facing life terms without parole for juvenile offenses.

"We are aware of four or five others that are potentially coming up for resentencing soon", Mark Fairbairn, spokesman for the Colorado Department of Corrections, said in a statement.

The Missouri Supreme Court continues to sort out such cases. The appeals court left his sentence in place.
